The Volunteer (for themselves if over the age of 18, or on behalf of the Volunteer as their parent or legal guardian) agrees to this Waiver, Release, and Media Consent in consideration for their participation in the Program.

Acknowledgement. The Volunteer acknowledge that as a volunteer, the Volunteer is providing volunteer services for their own benefit with a goal of gaining experience in the industry or fulfilling academic requirements. Some of the activities the Volunteer will be performing may require physical exertion and the Volunteer represents to OSEG Foundation that they are in good health and able to perform physical activities. The Volunteer will advise a supervisor if at any time they do not feel comfortable carrying out any of the volunteer activities. The Volunteer understand and agree that as a volunteer, I am not an employee, agent, or servant of OSEG Foundation. None of the benefits provided by OSEG Foundation to its employees, including but not limited to minimum wage and overtime compensation, workers’ compensation insurance and employment insurance, shall be available from or through OSEG Foundation to the Volunteer.

Waiver. The Volunteer understands and acknowledges participation in the Program exposes the Volunteer to the risk of serious bodily injury or death from many potential causes including, but not limited to: collision with other participants, personnel, including support personnel, equipment or the ground; imperfect surface conditions; or demanding physical exertion. BY PARTICIPATING IN THE PROGRAM THE VOLUNTEER FREELY ASSUMES THESE RISKS.

Release. The Volunteer and for their heirs, representatives and administrators, hereby waives, forever discharges and holds harmless OSEG Foundation and its affiliates and related companies, including, Lansdowne Stadium Limited Partnership, Ottawa REDBLACKS Limited Partnership, and Ottawa 67’s Limited Partnership (collectively, the “OSEG Foundation Parties”), together with the respective partners, directors, officers, trustees, employees, agents, sponsors, scouts, volunteers, consultants, representatives, affiliated and related entities, and their heirs, successors and assigns from any and all costs (including, without limitation, actual legal costs), claims, demands, actions, causes of action and liabilities whatsoever for any and all damages, losses, death or injuries, exposure to communicable diseases, viruses, bacteria or illness or their respective causes, whether to persons or property or both sustained by the Volunteer, their heirs, successors, assigns and personal representatives, directly or indirectly, in relation to the Program DUE TO ANY CAUSE WHATSOEVER. The Volunteer acknowledges OSEG Foundation does not insure the Volunteer while attending or participating in the Program.

Media Consent. The Volunteer hereby gives the OSEG Foundation Parties permission to take video, still photographs and/or digital photographs of the Volunteer during the Program, and use Volunteer’s image within such media in training, promotional, endorsement and publicity activities related to the OSEG Foundation Parties.

Confidentiality. I agree to keep confidential any information I may learn regarding OSEG Foundation’s business or its operations. I have read and agree to abide by the Confidentiality of Information and Ownership of Proprietary Property provisions set out in the attached Schedule A and acknowledge that the provisions are incorporated by reference into this Agreement.

This Waiver, Release, and Media Consent is governed by the laws of the Province of Ontario. If any portion of this Waiver, Release, and Media Consent is declared invalid or unenforceable the remainder shall remain in full force and effect, as such invalid portion shall be deemed severable.

In signing this Agreement, The Volunteers acknowledges and represents they have read this entire document, that understand its terms and provisions, that it affects the Volunteer’s legal rights, and that it is a binding agreement on the Volunteer, their heirs, next of kin, personal representatives, executors, administrators and successors, and that the Volunteer signs it knowingly and voluntarily.
