COACH WAIVER

Definitions.

For purposes of this Agreement, “Girls on the Run” or “GOTR” means Girls on the Run International together with (1) its associated Girls on the Run councils, including independent 501c3 organizations authorized or licensed to operate Girls on the Run programs, and (2) its local partner sites, including but not limited to local schools, parks, and facilities where Girls on the Run programs are conducted (collectively, “GOTR”). This Agreement applies to GOTR and its respective owners, directors, affiliates, officers, contributors, sponsors, employees, contractors, agents, volunteers, and assigns (collectively, the “Released Parties”).

Signer Authority.

I represent and warrant that I am either (a) eighteen (18) years of age or older and executing this Agreement on my own behalf, or (b) the parent or legal guardian of a minor volunteer coach (the “Junior Coach”), and I have full legal authority to execute this Agreement on behalf of myself and the Junior Coach. If executed by a parent or legal guardian, all assumptions of risk, releases, waivers, consents, and acknowledgements in this Agreement apply to both the Junior Coach and to me, to the fullest extent permitted by applicable law.

I, as a volunteer of Girls on the Run, agree to the following:  

I will not deliver the Girls on the Run International program unless I am working as an employee or volunteer of a Girls on the Run Council. 

I will not create or help develop a program that has similar goals and structure to that of Girls on the Run International within a two-year period of my involvement with Girls on the Run. 

I understand that all printed materials given to me are under copyright law and may not be reproduced in any way unless written permission is received. 

I understand that curriculum books given to me for the purpose of coaching Girls on the Run do not belong to me and must be returned at the end of the season. 

I will comply with all Girls on the Run trademark and logo usage guidelines and understand that unauthorized use is prohibited.

Program Participation: I am a volunteer coach with Girls on the Run and understand that my role involves participation in physical activities and interaction with participants during program practices, lessons, trainings, and other Girls on the Run–branded program activities (collectively, the “Program Activities”). I understand that physical activity involves inherent risks, including but not limited to slips, falls, collisions, overexertion, weather-related conditions, equipment-related hazards, and the actions or omissions of other participants, volunteers, or third parties. If the volunteer coach is a minor, these Program Activities include all participation by the Junior Coach under the supervision of GOTR.

Assumption of Risk: I knowingly and voluntarily assume all risks, both foreseeable and unforeseeable, arising out of or related to my participation in the Program Activities, including, without limitation, physical or emotional injury, illness, damage to property, and death, whether caused by my own actions, the actions of others, environmental conditions, or otherwise.

Release of Liability: On behalf of myself and, if applicable, the Junior Coach, and our family members, heirs, executors, administrators, and personal representatives, I hereby release, discharge, and covenant not to sue, and agree to indemnify and hold harmless GOTR and the Released Parties from and against any and all claims, causes of action, demands, damages, losses, costs, expenses, and attorneys’ fees of any kind, whether known or unknown, arising out of or related directly or indirectly to my participation in the Program Activities, even if caused, in whole or in part, by the negligence or negligent acts or omissions of GOTR, to the fullest extent permitted by applicable law.

Consent to Emergency Medical Treatment: I hereby authorize GOTR, if after making reasonable efforts under the circumstances to reach an emergency contact or authorized individual, or if sound medical practice decrees that there is not time to make such an attempt, to consent to any x-ray examination, anesthetic, dental, medical, or surgical diagnosis or treatment, and hospital care, to be rendered to me or, if applicable, the Junior Coach under the general or special supervision and on the advice of any physician, surgeon, or other health care professional who may treat me or, if applicable, the Junior Coach including transportation required for such care. I agree to pay for any such treatment. I agree to reimburse GOTR for all costs and expenses it may incur related to such treatment. I also understand that this GOTR Council may not carry accident medical insurance and that such insurance coverage is my responsibility. I acknowledge that GOTR is not a medical provider and does not employ healthcare professionals.

Acknowledgement; Severability; Jury Waiver: I acknowledge that I am either eighteen (18) years of age or older, or the parent or legal guardian of the Junior Coach, that I have carefully read and understand this Agreement, that I have had the opportunity to ask questions before signing, and that I voluntarily agree to its terms on behalf of myself and, if applicable, the Junior Coach, including the waiver of the right to a trial by jury to the fullest extent permitted by applicable law. I expressly agree that this Agreement is intended to be as broad and inclusive as permitted by applicable law, and that if any provision is held invalid or unenforceable, the remaining provisions shall nevertheless continue in full force and effect. To the fullest extent permitted by applicable law, I hereby irrevocably and unconditionally waive any right to a trial by jury in any legal action or proceeding arising out of or relating to this Agreement.

Law and Venue. This Agreement shall be governed by North Carolina law, without regard to any conflict-of-law rules. Any litigation related to this Agreement shall be filed and occur exclusively in the state or federal courts in North Carolina, and in no other venue. I irrevocably consent to the jurisdiction of and venue in such courts for such disputes. I agree that this Section is a material and reasonable part of this Agreement, that GOTR’s headquarters are in North Carolina, and that I will not contest the enforceability of the provisions in this Section in any forum.

Photo Release: I hereby grant GOTR and its affiliated councils, partners, licensees, contractors, and service providers the irrevocable right to use photographs, video recordings, and audio recordings of me taken in connection with my volunteer activities for GOTR, for lawful organizational purposes including marketing, fundraising, promotional, and educational purposes, in any media now known or later developed. 

5K Event Participation. I understand and agree that if I participate in, attend, or am present at a Girls on the Run 5K event in any capacity, including as a coach, volunteer, runner, or spectator, I must separately execute the applicable Girls on the Run 5K Event Waiver, which governs all risks, releases, consents, and emergency medical authorizations related to such event participation.

Text Messaging Communications Girls on the Run would like to send text messages that will allow you to receive important program and 5K updates, including emergency messages prior to the 5K.  Message and data rates may apply.  When you receive a SMS/Text Message you can reply STOP to unsubscribe at any time. Please note, this may prevent you from receiving important notifications in the future. Girls on the Run will respect the confidentiality of information you provide pursuant to the Girls on the Run privacy policy. You can change your contact information by emailing us at any time. If executed by a parent or legal guardian of a Junior Coach, this consent applies to communications sent to the contact information provided by the parent or guardian.
