The newly amended Child Protective Services Law (Act 153 of 2014) requires all volunteers having direct contact with children to obtain new background clearances (child abuse background check and state and federal criminal history checks) every 60 months.

I swear/affirm that I have mailed or filed the following requests for clearances to Childline, the Pennsylvania State Police, and the Federal Bureau of Investigation.

If you have continuously lived in PA for 10 years and have never been convicted of a disqualifying crime in PA or the corresponding offenses under the law of any other jurisdiction, you do not need to submit an FBI clearance check

I swear/affirm that I have not been named as a perpetrator of a founded report of child abuse, an individual responsible for a founded report as defined by the Child Protective Services Law or convicted of any of the Reportable Offenses listed below:

A Reportable Offense enumerated under Pennsylvania’s Child Protective Services Law, 23 Pa.C.S. §6344(c), consists of one or more of the following:

1. Provisions of Title 18 of the Pennsylvania Consolidated Statutes (relating to crimes and offenses) or an equivalent crime under the laws or former laws of the United States or one of its territories or possessions, another state, the District of Columbia, the Commonwealth of Puerto Rico or a foreign nation, or under a former law of the Commonwealth of Pennsylvania:

§ Chapter 25 relating to criminal homicide

§ Section 2702 relating to aggravated assault § Section 2709.1 relating to stalking

§ Section 2901 relating to kidnapping

§ Section 2902 relating to unlawful restraint § Section 3121 relating to rape

2. An offense designated as a felony under the act of April 14, 1972 (P.L. 233, No. 64), known as “The Controlled Substance, Drug, Device and Cosmetic Act,” committed within the preceding five-year period.

3. A founded report of child abuse within the preceding five-year period in the statewide database maintained by the Department of Human Services.

I understand that I must be dismissed if I am named as a perpetrator of a founded report of child abuse within the past five (5) years or have been convicted of any crimes, other than a traffic violation.

I hereby swear/affirm that the information as set forth above is true and correct to the best of my knowledge and belief. I have read and understand the foregoing. I understand that the penalty for false swearing is a misdemeanor of the third degree pursuant to Section 4903(b) of the Criminal Code.
